The Sloppy Tuna's Court-Appointed Receiver Says It's Not Closing

Says the restaurant will return under its own name

Curbed was the first to bring you the news about the uncertain status of the Sloppy Tuna, the controversial Montauk bar/restaurant. Owing to the various lawsuits filed by the warring owners, New York State Supreme Court Justice Jerry Garguilo issued a restraining order requiring the bar/restaurant to be run by a court-appointed receiver, attorney Charles C. Russo, for the time being.

Last evening, owner Drew Doscher posted a tirade on the Sloppy Tuna Facebook page stating that

The Sloppy Tuna as you and we know it will unfortunately not be opening at the same location in Montauk this summer – due to some sudden and unforeseen chaos and back room politics.

We will definitely be popping up somewhere soon – keep your eyes and ears open in the next few weeks for what’s to come next for The Sloppy Tuna!! Read below for more details…

This evening, we’re in possession of a letter sent by the court-appointed receiver, Charles C. Russo, to Drew Doscher’s lawyer, dated today, March 30, which states the following.

As you will recall, pursuant to the Court’s Order of March 16, 2016, your client is “restrained from interfering in any way with the Court-appointed Temporary Receiver in his operation and management of the company.” It is clear that your client’s actions last night have significantly interfered with my operation and management of the company, in direct violation of the Court’s Order.

Despite your client’s best efforts, I have every intention of making sure the restaurant opens on time and has a successful season.

The letter orders Mr. Doscher to cease and desist “any current use, and refrain from any future use, of the name ‘The Sloppy Tuna'” until lawsuits are resolved. Furthermore, that all news outlets, including Curbed, should be informed that “the restaurant will be returning to the Montauk location this summer under new management and that no other Sloppy Tuna restaurant will be opened at any other location.”
